TERMS AND CONDITIONS OF SALE
All products are subject to availability.
Management reserve the right to change the prices without prior notice.
Orders under the minimum order amount of £10 OR outside the delivery radius of 3 miles will incur a surcharge
Our delivery charge is £2.
Food items in the “All Day Specials” are served in a tray to save on time and costs for customers and for us.
Any item requested separately will be a subject to a surcharge.
Offers cannot be used in conjunction with other offers.
Online promo deals are not available in store or over the phone.
You may only place orders if you are at least 18 years old. By ordering, you warrant that you are at least 18 years old and you are legally capable of entering into binding contracts.
Delivery times given are a guidance ONLY. We endeavour to deliver your order piping hot as soon as possible HOWEVER we cannot guarantee the stated time due to reasons beyond our control.
Delivery will be made to your doorstep outside your front door only. Urban Foodz Limited and its staff, will not deliver to any address in apartment blocks, flat or hotels, but only main door/reception areas of the building, depending on access and the driver’s knowledge of the local area and if they can/wish to.
If delivery is late, you accept that this was a possibility due to any number of reasons and by placing an order, you revoke your right to claim a partial/full refund. The restaurant will attempt to keep you updated about the status/progress of your order – via an automated system of either email, push notification, SMS message – by whichever method will be convenient/possible at the current time. If however, on any occasion no update is received by the customer before the delivery for whatever reason, you acknowledge that this is not part of the product you are paying for but just an added service and therefore waives your right for any reasons for refund. Any refund issued will be solely at the management’s discretion and you accept this. You may cancel your order at least a minimum of 24 hours of delivery (if ordered days in advance) or within a reasonable time prior to any food being used to prepare your order. You may, only at the management’s discretion, be charged partially or full price and no refund will be due to you.
In light of the current situation surrounding COVID-19, we feel staff are at a high level of risk as is the wider community. We will attempt to call the customers immediately before the delivery so we can leave it on/in their doorstep. Please can all customers make sure the contact details are correct and phones are kept nearby to minimise disruption/waiting times and to receive calls as we don’t want the food to be waiting too long. By placing the order you acknowledge and agree to these terms and conditions. We will endeavour to make sure the delivery is promptly made after making contact with the customer, however the customer will not hold Urban Foodz Limited responsible for any item in your order that is not of usual standard and expectations.
EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a “Force Majeure Event“).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond both our reasonable control and the reasonable control of our Franchisees and includes in particular (without limitation) the following:
- strikes, lock-outs or other industrial action;
- civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
- fire, explosion, storm, flood, extreme snow, ice, earthquake, subsidence, epidemic or other natural disaster;
- impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
- impossibility of the use of public or private telecommunications networks;
- the acts, decrees, legislation, regulations or restrictions of any government; or
- non-performance by suppliers or subcontractors.
WAIVER
If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or delay in doing so, that will not mean that we have waived our rights against you or that you do not have to comply with those obligations. If we waive a default by you, this will only be done in writing, and will not mean that we will automatically waive any later default by you.
SEVERABILITY
Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
ASSIGNMENT
We may transfer our rights and obligations under any contract with you to another organisation, but this will not affect your rights or our obligations under these terms and conditions. You may only transfer your rights or your obligations under these terms and conditions to another person if we agree in writing.
ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between you, us and our Franchisees, whether oral or in writing.
VARIATION OF THESE TERMS AND CONDITIONS
We have the right to amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the policies and terms and conditions in force at the time that you order, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority.
THIRD PARTY RIGHTS
No one other than a party to these terms and conditions shall have any right to enforce any of its terms and conditions.
LAW AND JURISDICTION
Any dispute or claim arising out of or in connection with your order or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
